John Kahl Mentorship and Consulting, LLC d/b/a ACLRx ("we," "us," "Company") operates johnkahldpt.com, aclrx.com, and related landing pages, forms, scheduling links, and social profiles (the "Site"). This Policy explains what we collect, how we use it, and your choices. By using the Site or submitting information, you agree to this Policy. If you do not agree, do not use the Site.
Name, email, phone, mailing address, age, and social handles; scheduling and call information; information you submit on intake, application, discovery, or e-book forms, including injury type, surgery date, symptoms, activity level, goals, and other health-related details; messages you send by form, email, SMS, DM, or chat; testimonials, photos, and video you submit; and payment information, which is collected and processed by our payment processor — we do not store full card numbers.
IP address, device and browser type, operating system, referring URLs, click IDs and campaign parameters (including advertising identifiers such as fbclid and UTM tags), pages viewed, time on page, and similar analytics data, collected through cookies, pixels, tags, and SDKs, including advertising and analytics tools operated by Meta, Google, and our marketing platform. You can control cookies through your browser settings; some Site features may not work if you disable them.
Information you voluntarily provide about your injury, surgery, symptoms, or physical condition is collected only to evaluate fit and deliver services you request, and only with your consent, which you give by submitting it. Our programs are online coaching and education, not the practice of physical therapy. We are paid directly by clients, do not bill insurance, and do not issue superbills, so we are not a HIPAA-covered entity; we nonetheless handle this information under applicable New York and other state privacy law. We do not sell health-related information, do not use it for targeted advertising, and do not share it with advertising platforms. You may withdraw consent at any time by emailing us; withdrawal does not affect processing already performed.
To respond to inquiries and book calls; to evaluate applications and deliver, personalize, and support our programs; to process payments; to send service, scheduling, and account messages; to send marketing you have consented to receive; to measure and improve our content, ads, and Site; to detect fraud and secure our systems; and to comply with law, enforce our terms, and establish or defend legal claims.
By providing your phone number and opting in, you consent to receive informational and marketing calls and text messages from us, including messages sent using automated technology. Consent is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to opt out and HELP for help; our full Messaging Terms are posted on the site. Carriers are not liable for delayed or undelivered messages. We do not sell, rent, or share mobile opt-in information or SMS consent with third parties for their own marketing purposes.
With service providers who process data on our behalf under contract — website and CRM platform, email and SMS delivery, scheduling and video conferencing, coaching and exercise-delivery software, payment processing, file storage, analytics, and contractors who support fulfillment and client communication, all bound by confidentiality obligations; with advertising and analytics partners for measurement and audience purposes, limited to non-health data as described above; with professional advisors; in connection with a merger, financing, or sale of assets; and when required by law, subpoena, or to protect rights, safety, or property. We do not sell personal information for money.
We keep personal information only as long as needed for the purposes described, to meet legal, tax, insurance, and recordkeeping obligations, and to resolve disputes, then delete or de-identify it. We maintain administrative, technical, and physical safeguards designed to meet the New York SHIELD Act and other applicable standards, including access controls, unique credentials, and vendor diligence. No system is perfectly secure; you transmit information at your own risk, and we will notify affected individuals of a breach as required by law.
You may request access to, correction of, a copy of, or deletion of your personal information, and may opt out of marketing at any time, by emailing the address below; we will verify your identity before acting and will not discriminate against you for exercising these rights. Depending on where you live, you may also have the right to opt out of targeted advertising, the sale or sharing of personal information, and profiling, to limit use of sensitive information, and to appeal a denial — including under the California Consumer Privacy Act, the Washington My Health My Data Act, and comparable state laws. If you are in the EEA or UK, our legal bases are consent, contract, and legitimate interests; you may withdraw consent, object, or lodge a complaint with your supervisory authority, and you consent to transfer of your information to the United States, which may have different data-protection standards.
The Site is intended for adults. We work with clients under 18 only where a parent or legal guardian submits the intake information, attends the assessment call, signs the waiver, and consents to participation. We do not knowingly collect information from a minor without that consent; if you believe we have, email us and we will delete it promptly.
The Site links to and integrates with third-party services, including social media, scheduling, payment, and course platforms. Their handling of your information is governed by their own policies, not this one, and we are not responsible for their practices.
We may update this Policy at any time; the "Last updated" date shows when. Material changes will be posted on this page and, where required, communicated directly. Continued use after posting constitutes acceptance.
